These Terms of Use ("Terms") govern your access to and use of the website, mobile web application, and related services provided by Careful Technologies, Inc. ("Careful," "we," "us," or "our"), collectively referred to as the "Services." By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility
You must be at least 16 years old to create an account or use the Services. By using the Services, you represent that you meet this age requirement and that all information you provide during account creation is accurate. If we become aware that an account belongs to someone under 16, we reserve the right to suspend or terminate that account.
3. Account Registration
To use the core features of the Services, you must create an account using Google authentication or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, including your name, country, and age, and to keep that information up to date.
4. Description of the Services
Careful is an AI powered assistant designed to help users assess the potential risk of scams, fraud, or suspicious communications, and to provide general educational content, news, and guidance related to scam awareness. The Services include a chat assistant, a personal dashboard, a resource and guide library, a news feed, and account management features.
5. The Services Are Not a Guarantee of Protection
Careful is a tool intended to assist your own judgment, not to replace it. The Services do not guarantee that you will avoid being scammed, defrauded, or financially harmed, whether or not you rely on information, risk scores, red flags, or recommendations provided by Careful. You remain solely responsible for your own decisions, including financial transactions, communications, and any actions you take or do not take based on information from the Services.
Risk assessments, red flags, and recommendations generated by Careful are produced using artificial intelligence, including large language models and real time web search, and are provided for informational purposes only. These outputs may be incomplete, outdated, or incorrect. Careful does not independently verify every piece of information referenced in a response, and you should exercise your own judgment and, where appropriate, seek independent verification or professional advice before acting.
6. Not Financial, Legal, or Professional Advice
Nothing provided through the Services constitutes financial, legal, tax, medical, or other professional advice. Any general suggestions regarding safer financial alternatives are educational in nature and are not a recommendation to buy, sell, or invest in any specific product, security, or asset. You should consult a licensed professional before making significant financial, legal, or personal decisions.
7. Acceptable Use
You agree to use the Services only for their intended purpose of scam awareness and prevention. You agree not to:
Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
Attempt to use the AI assistant for purposes unrelated to scam prevention, or attempt to manipulate, exploit, or bypass its intended scope and safeguards.
Submit content that is unlawful, abusive, or that infringes the rights of any third party.
Attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Services, including any underlying systems or infrastructure.
Use automated means, including bots or scrapers, to access the Services without our prior written consent.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity, in connection with your use of the Services.
We reserve the right to suspend or terminate accounts that violate this section, at our discretion.
8. User Submitted Content
When you submit text, screenshots, documents, links, or other content to the AI assistant ("User Content"), you retain ownership of that content. By submitting User Content, you grant Careful a limited, non-exclusive license to process, store, and use that content as necessary to operate and improve the Services, including generating responses, populating your dashboard, and, where content is aggregated and de-identified, improving our understanding of scam trends more broadly. You are responsible for ensuring you have the right to submit any content you provide, including content involving third parties.
9. Subscription and Billing
Careful is offered under a single subscription plan. New accounts receive a 7 day free trial. Unless canceled before the trial period ends, your subscription will automatically convert to a paid plan billed at $1 per month, charged to the payment method on file through our payment processor, Stripe.
You may cancel your subscription at any time through the app's Settings. Cancellation will take effect at the end of your current billing cycle, and you will retain access to the Services through the end of that period. We do not offer refunds for partial billing periods or unused time, including if you cancel mid-cycle.
We reserve the right to change our pricing with advance notice. Continued use of the Services after a price change takes effect constitutes acceptance of the new pricing.
10. Account Termination
You may delete your account at any time through Settings, which will remove your access to the Services and initiate deletion of your personal information in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason at our discretion, including discontinuation of the Services.
11. Intellectual Property
The Services, including all software, design, text, graphics, guides, and other content created by Careful (excluding User Content), are the property of Careful Technologies, Inc. and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
12. Third Party Services
The Services rely on third party infrastructure and providers, including artificial intelligence model providers, web search functionality, payment processing, and news content providers. We are not responsible for the accuracy, availability, or performance of these third party services, and your use of the Services is also subject to the applicable terms of those providers where relevant.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR FREE, OR THAT ANY RISK ASSESSMENT, RECOMMENDATION, OR CONTENT PROVIDED THROUGH THE SERVICES WILL BE ACCURATE OR COMPLETE.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CAREFUL TECHNOLOGIES, INC. AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, LOSS OF DATA, OR FINANCIAL HARM RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CAREFUL IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Careful Technologies, Inc., its officers, employees, and affiliates from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
16. Dispute Resolution and Arbitration
Please read this section carefully, as it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court where eligible.
Arbitration will be conducted on an individual basis. You and Careful agree to waive any right to participate in a class action lawsuit or class-wide arbitration. The arbitration will be administered under the rules of a recognized arbitration organization, and will take place in Delaware, or another mutually agreed location, unless applicable law requires otherwise.
If any part of this arbitration provision is found unenforceable, the remainder shall remain in effect, and any claim not subject to arbitration shall be resolved in the courts located in Delaware.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, except where applicable law requires otherwise based on your location.
18. Changes to the Services and These Terms
We may modify or discontinue any part of the Services at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice, such as through the app or via email, before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
19. Institutional and Partner Use
Careful may, at its discretion, make its technology available to institutional or business partners under separate agreements, which may include different or additional terms specific to that relationship. These Terms of Use govern individual consumer use of the Services and do not apply to institutional integrations governed by a separate agreement.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
